Charges Upgraded Against Children in Garland Murders

Dallas, TX – A 12 year old girl and 13 year old boy under arrest for shooting a Garland couple now face two counts of "capital murder." KERA's BJ Austin says the second victim has died.

August 17th, Garland Police officers found 48 year old Alan Nevil lying in his front yard - shot and wounded. His wife, 46 year old Darlene was found dead in the house - shot in the head. Alan Nevil was able to give officers information that led them to the pre-teens, who were arrested a short time later. Police Officer Joe Harn says Alan Nevil died last night, and because there are "two" murder victims, the charges upgrade to "capital murder", which can bring as many as 40 years if convicted: part in juvenile detention, the rest in adult prison. Officer Harn says he can't say much more than that about the young girl and boy.

Harn: By law, we cannot identify either one of these kids, and by doing any type of relationship might lead to identifying one of them, so us - as a police agency - we're not allowed to say anything that might identify either one of them.

But neighbors and family have said the 12 year old was Darlene Nevil's daughter and the 13 year old her boyfriend.

Officer Harn says he cannot recall Garland Police charging anyone so young with capital murder.

Harn: It has upset a community that lives in and around where the Nevil's lived, and anyone who was associated with the kids. This has been as case that has touched us in the Police Department also. It's just something we don't see, and it's just been a very disturbing case.
