Dallas, TX – Hood's attorneys argued that a prosecutor was having an affair with the trial judge in the case where the jury found the accused guilty of a brutal double murder in Plano nearly 20 years ago.
They cited a conflict of interest and a violation of legal ethics. The argument was initially rejected by the Texas Court of Criminal Appeals. So attorneys went back to the court to try again.
About an hour ago, Collin County State district judge Curt Henderson withdrew the execution warrant. Lawyers had sought documents tied to the alleged affair between the judge and the prosecutor.
Hood would've been the 2nd inmate put to death in Texas following a temporary halt to executions nationwide.
